Clear, transparent contracts

At Canadian Halal Financial Corporation we ensure that the terms of our contracts are fair, clear, and easy to understand for our clients. We encourage our clients to have our contracts reviewed by their own lawyers before entering into an agreement. 

The form and content of our contracts have been approved by independent lawyers and Fatwa Committees, including the Al Azhar.

Compliant with and enforceable by Canadian law

Canadian Halal Financial Corporation financing contracts are Sharia Law complaint and are enforceable by Canadian Courts of Law.

Halal Financing Principles

  • Each agreement is Sharia compliant;

  • Agreements have been reviewed by Sharia Law scholars and Fatwa Committees, who have certified that the contract forms are Sharia Law compliant and may be used by any Muslim purchaser;

  • All agreements have been reviewed by Canadian lawyers who have confirmed that the agreements protect the purchaser to the high standards protecting any Canadian purchaser;

  • Each of the Murabaha and Musharakah agreements used are certified as Sharia Law compliant by a Fatwa;

  • Each finance agreement is between the purchaser and the Canadian Halal Financial Corporation, and each home purchased is chosen and owned by the purchaser;

  • Each financing applicant must qualify in accordance with the current Canadian standards to ensure the costs of purchasing your home does not exceed your financial capacity.

Application considerations

Every buyer is to confirm that the purchase is for an owner-occupied home.  Each buyer must participate in a financing application including:  

  • Delivery of personal information so as to allow the Canadian Halal Financial Corporation to determine the capacity of the buyer to qualify for the amount of financing that the buyer may require; all information provided shall be held as confidential information and not disclosed to any party other than as necessary by the Corporation to qualify the individual buyer for financing; 

  • The buyer must fund a minimum of twenty (20%) percent of the lower of the purchase price or the appraised value of the property to be purchased;

  • The buyer must execute all financing documents as required and approved by Fatwa Committees;

  • The Canadian Halal Financial Corporation requires that each prospective buyer arrange an appointment with the Corporation to discuss all elements of a financing application.
